$124,473 in Claims Filed in 2004 Against Boersch Farms

Three different plaintiffs filed suits against Boersch Farms totalling nearly $125,000 in 2004.

R. Oliphant Farms Ltd., James Rennick and Marina Commodities were the owed these monies and had to use the courts to finally encourage Gisela Boersch to finally pay her debts.

Josef and Gisela Boersch have a history of intentionally avoiding paying their debts. They have and will continue to be unethical in their business and personal dealings.

In April 2005 I sold lentils to Boersch Farms Ltd; since payment was not sent or received by the due date according to original contract we went to pick up the cheque close to two weeks after due date.
The cheque was declared NSF ($ 34,004.98), there was no explanation given, we turned the case over to the RCMP for criminal investigation.
In May of 2006, I was subpoenaed for a court hearing; the hearing was put off by the crown prosecutor and I was told that the crown prosecutor tried to negotiate with Boersch to pay us out. Two weeks later I received a letter from the crown prosecutor informing me about a stay of proceedings.
In a phone conversation I was told that the crown has difficulty proving intend to defraud at the signing of the contract. I indicated that Mr. Boersch has a list of civil suits against him with several judgments because of payment irregularities. I was told the civil suits can not be used in a criminal case.
The other reason for not persecuting was the fact that there were funds sometimes in the account (not at the time or after the cheque was deposited); I asked specifically if that can be outside the given time frame (before and after). The answer was yes; I pointed out to the crown prosecutor that this amounts to a free ticket to issue NSF cheques and he was not able to deny this fact.
My case was combined with a similar case were the amount outstanding was around a quarter Million $; this case was dropped the same way.

A few days before Christmas 2005 I received a fax from Mr. Ken Karwandy from KMP Law in Regina who is representing Boersch Farms LTD. In the fax he indicated that I am one of fifteen parties who receive the same proposal for settlement of the total outstanding debt owed by Boersch Farms Ltd with a payment plan. To this point I have not received any funds and I do not know of anybody who has received any payment under the terms of proposal.
I phoned Mr. Karwandy the day before the first payment was due to remind him about it and he indicated that he could not promise any payment.

There are several questions:
What role does the bank play by allowing NSF cheques to be issued at various times?
What is the fiduciary duty of the Canadian Grain Commission to enforce the The Grain Act under which anybody buying lentils for resale needs to be bonded and licensed?
There was supposedly a deadline for licensing and bonding on August 1, 2006 and there are still companies out there which are not licensed as of January 2, 2007.
The Rice Company Canada Inc. is to my knowledge not licensed.

The Rice Company holds a 10 % share Boersch Farms Ltd since March 15, 2001; the Rice Company Canada Inc is currently using the facility of Boersch Farms for processing. Josef Boersch is managing the plant.

Boersch Farms Ltd. is registered with the Saskatchewan Justice Corporations Branch as “inactive (struck off)” as of September 30, 2006. Josef and Gisela Boersch each hold 45 % of the shares of Boersch Farms Ltd.

Gisela and Josef Boersch are two of three current Directors of The Rice Company Canada INC since its incorporation dated October 29, 2001; all issued shares are held by Kapila Revocable Trust of California.


A few days before Christmas 2006 a neighbor came to see me to inquire if I have been paid by Boersch; Josef Boersch approached him for Canary seed seeking delivery as soon as possible. Mr. Boersch apparently indicated that he would be interested in acquiring lentils later on. This neighbor has done business with Boersch in the past, has been paid but admitted that the lag time of payments has increased.
